CFTC approval creates first US stock perpetual market

The U.S. Commodity Futures Trading Commission announced on November 3 that equity perpetual contracts now qualify as security futures under joint CFTC and SEC oversight.

The decision allows trading of stock‑linked perpetual futures on CFTC‑registered exchanges, ending the reliance on offshore platforms for such products.

Hyperliquid’s HYPE token reacts to regulatory shift

Following the announcement, Hyperliquid’s native token HYPE posted a notable rise, reflecting market confidence in the new regulatory framework.

Hyperliquid’s HIP‑3 framework already supports the largest on‑chain market for perpetuals on stocks such as Apple, Nvidia and Tesla, with daily turnover measured in hundreds of millions of dollars.

Institutional partners gain a legal pathway

Financial services firm ICE, owner of the NYSE, previously invested in Hyperliquid’s trade[XYZ] platform and now has a clear legal basis to launch a regulated American exchange using the technology.

Payward, the parent company of Kraken, is accelerating development of a similar product on the regulated exchange Bitnomial, leveraging the same infrastructure.

Implications for US traders and market structure

CFTC Chair Michael Selig highlighted that the move offers U.S. traders a regulated alternative to offshore venues, aiming to bring billions of dollars of volume back into domestic markets.

While Hyperliquid will continue to geoblock U.S. residents, the platform’s on‑chain liquidity, 24/7 trading and flexible margin conditions remain available to global users.

Early market dynamics and future outlook

Local U.S. exchanges are expected to face initial constraints from traditional Wall Street trading hours and SEC leverage limits, but the broader ecosystem may benefit from fee revenue generated by regulated partners.

Analysts note that the CFTC’s use of the Commodity Futures Modernization Act of 2000 to classify equity perps avoids the need for new legislation, underscoring a pragmatic regulatory approach.

The CFTC’s November 3 release clarified that equity perpetual contracts are now classified as security futures and may be listed on dual‑registered exchanges, a detail highlighted in the u.today report. This regulatory classification aligns with the Commodity Futures Modernization Act of 2000, which the agency cited as eliminating the need for new legislation (u.today).

According to the same source, Hyperliquid’s HIP‑3 framework, particularly its trade[XYZ] platform, already underpins the largest on‑chain market for perpetuals on stocks such as Apple, Nvidia and Tesla, generating daily turnover measured in the hundreds of millions of dollars (u.today).

The announcement also gives financial giant ICE, the owner of the NYSE, a clear legal pathway to build a regulated U.S. exchange using Hyperliquid’s technology, after its prior investment in the trade[XYZ] platform (u.today).

Payward, the parent company of Kraken, is accelerating development of a comparable product on the regulated exchange Bitnomial, leveraging the same infrastructure that supports Hyperliquid’s current offerings (u.today).

CFTC Chair Michael Selig emphasized that the decision provides U.S. traders with a regulated alternative to offshore venues, aiming to return billions of dollars of trading volume to domestic markets (CoinDesk).
